Terms and Conditions For Unique Couriers

1. Introduction
These Terms and Conditions ("Terms") govern the use of courier and delivery services provided by Unique Couriers ("we," "us," or "our"). By using our services, you ("Customer," "you," or "your") agree to be bound by these Terms.
2. Definitions
"Service" refers to all courier, delivery, and logistics services provided by Unique Couriers. "Shipment" means any package, parcel, document, or goods tendered to us for delivery. "Consignee" means the person or entity to whom a Shipment is addressed. "Prohibited Items" means items that are illegal, dangerous, or restricted from transport as outlined in Section 5.
3. Service Agreement
3.1 Acceptance of Shipments
We reserve the right to refuse any Shipment at our sole discretion. Acceptance of a Shipment does not constitute a warranty that delivery will be completed by a specific time unless expressly guaranteed in writing.
3.2 Booking and Confirmation
All bookings must be made through our authorized channels (website, mobile app, phone, or in-person). Customers will receive confirmation of booking details, including pickup and delivery addresses, estimated delivery time, and pricing.
3.3 Customer Responsibilities
Customers must: Provide accurate pickup and delivery information Ensure Shipments are properly packaged and labelled Declare the contents and value of all Shipments accurately Comply with all applicable laws and regulations Be available or designate an authorized representative for pickup and delivery
4. Pricing and Payment
4.1 Fees
Service fees are based on factors including but not limited to: distance, delivery speed, and any special handling requirements. All quoted prices are in Australian currency and exclude taxes unless otherwise stated. All fees are subject to alteration without notice. Account holders will be given 14days notice of any changes to our charges and our Terms and Conditions.
4.2 Payment Terms
Payment is due at the time of booking unless credit terms have been pre-arranged. We accept cash, electronic payment and bank transfer and credit and or debit cards, however the bank processing fee will be added to the courier charge. This rate currently stands at 2.2%. We do not accept American Express cards. Corporate accounts may be eligible for invoicing with a net-14-day payment terms period upon approval. Overdue invoices will incur a late payment fee of 2% per month or the maximum rate permitted by law, whichever is lower.
4.3 Additional Charges
Additional charges may apply for: Failed delivery attempts due to incorrect information or recipient unavailability Storage fees for unclaimed Shipments Special handling or oversized items Deliveries to remote or difficult-to-access locations Waiting time beyond 15 minutes at pickup or delivery location (first 15 minutes are complimentary) Parking fines maybe added to the customers invoice if applicable, if the fine was due to either party not having the goods ready or to the recipient keeping the driver waiting Tolls and other applicable charges may apply however these charges will be added to the customers invoice, if applicable
5. Prohibited and Restricted Items
5.1 Prohibited Items
Customers may not ship: Illegal substances or contraband Explosives, firearms, or weapons including Lithium or any other type of explosive battery or item Hazardous materials without proper documentation Perishable items without prior arrangement Live animals (except with special authorisation) Currency, negotiable instruments, or precious stones exceeding declared limits Human remains or medical waste Items that violate intellectual property rights
5.2 Inspection Rights
We reserve the right to inspect any Shipment if we suspect it contains Prohibited Items. Customers consent to such inspection by tendering a Shipment to us.
6. Delivery
6.1 Delivery Attempts
We will make reasonable attempts to deliver Shipments to the designated address. If delivery cannot be completed, we will attempt to contact the Customer or Consignee for further instructions. All paperwork will be amended to show the change.
6.2 Proof of Delivery
Delivery is deemed complete upon receipt confirmation by the Consignee or their authorised representative. Proof of delivery may include signature, photo confirmation, or electronic verification.
6.3 Undeliverable Shipments
If a Shipment cannot be delivered after reasonable attempts, it will be held for five (5) business days, after which storage fees may apply. After thirty (30) days, undeliverable Shipments may be disposed of or returned to sender at senders expense.
7. Liability and Insurance
7.1 Limitation of Liability
Our liability for loss, damage, or delay to any Shipment is limited to the lesser of: The actual value of the Shipment (up to $100 AUD) The declared value of the Shipment (up to $100 AUD) The amount of insurance purchased for the Shipment if applicable. We are not liable for indirect, incidental, special, or consequential damages. We recommend the sender have adequate insurance to cover the replacement of the goods
7.2 Insurance
Customers are strongly encouraged to purchase additional insurance for high-value items. Insurance options may be presented at the time of booking, if available.
7.3 Claims Procedure
Claims for loss or damage must be submitted in writing within seven (7) days of delivery (or expected delivery date for lost items). Claims must include: Delivery Document Number Proof of value Photographic evidence of damage (if applicable) Completed claims form, Claim Forms are obtainable from our office, please call or email the company.
8. Delay and Force Majeure
We are not liable for delays or failures in service caused by circumstances beyond our reasonable control, including but not limited to: Natural disasters, severe weather, or acts of God War, terrorism, civil unrest, or public emergency Government actions, strikes, and or labour disputes Mechanical breakdowns or transportation failures Pandemics or public health emergencies
9. Customer Data and Privacy
We collect and process personal information in accordance with applicable data protection laws. By using our services, you consent to our collection and use of your information as described in our Privacy Policy, available on our website.
10. Tracking and Communication Customers can track Shipments in real-time by contacting the driver direct. We may communicate with Customers via SMS, email, phone, or push notifications regarding Shipment status.
11. Cancellations and Refunds
11.1 Cancellations Personal and Business
Customers may cancel bookings as follows: More than 1 hour before scheduled pickup: providing the Personal Customer has paid in advance, you will receive a full refund Less than 30 minutes before scheduled pickup: 50% cancellation fee of the flat rate providing the Personal Customer has paid in advance After pickup has occurred: no refund Cancelled and rebooked jobs do not incur any fees apart from the delivery charge.
11.2 Refunds Refunds will be processed within 5-10 business days to the original payment method.
12. Corporate Accounts Business customers may apply for corporate accounts with credit terms, simply fill in the attached account application form on this site. Corporate accounts are subject to credit approval and may require a deposit or guarantee. Separate terms may apply to corporate customers
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the jurisdiction in which Unique Couriers is registered, without regard to conflict of law principles.
13.2 Disputes
Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with local arbitration rules.
14. Indemnification
Customers agree to indemnify and hold harmless Unique Couriers, its employees, and or agents from any claims, damages, losses, or expenses arising from: Customers breach of these Terms Shipment of Prohibited Items, False or inaccurate information provided by Customer, Customers violation of any applicable laws, Motor vehicle breakdowns, Motor vehicle accidents.
15. Amendments
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website or notification to Customers. Continued use of our services after changes constitutes acceptance of the modified Terms.
16. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
